Terms of Service

Effective: April 8, 2026

1. Acceptance of Terms

By downloading, installing, or using any FinesseTech LLC ("FinesseTech," "we," "us," "our") application, product, service, or website (collectively, "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not access or use our Services. These Terms constitute a legally binding agreement between you and FinesseTech LLC.

2. Eligibility

You must be at least 13 years of age to use our Services. By using our Services, you represent and warrant that you meet this age requirement. Users between 13 and 18 must have parental or guardian consent. We do not knowingly permit use by children under 13.

3. Apple App Store — Additional Terms

If you download our applications through the Apple App Store, the following additional terms apply: (a) These Terms are between you and FinesseTech LLC only, not with Apple Inc. Apple has no obligation to provide maintenance or support for our apps. (b) In the event of any failure of an app to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligations. (c) Apple is not responsible for addressing any claims by you or any third party relating to our apps or your use of them. (d) Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple will have the right to enforce them against you.

4. License to Use

Subject to your compliance with these Terms, FinesseTech grants you a limited, non-exclusive, non-transferable, revocable license to download and use our applications on devices you own or control, solely for your personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of our Services, nor reverse engineer or attempt to extract source code.

5. Accounts and Registration

Some Services require account creation. You agree to: (a) provide accurate and complete information; (b) maintain the security of your password; (c) promptly notify us of any unauthorized account access at support@finessetech.site; (d) accept responsibility for all activities under your account. We reserve the right to terminate accounts that violate these Terms.

6. Account Deletion

You may delete your account at any time from within the app settings or by emailing support@finessetech.site with the subject line "Account Deletion Request." Upon deletion, we will remove your personal data in accordance with our Privacy Policy and applicable law. Some information may be retained for legal compliance purposes.

7. In-App Purchases and Subscriptions

Certain features may require payment or a subscription. All purchases are processed through the Apple App Store and are subject to Apple's payment terms. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions in your Apple ID account settings. We do not offer refunds except as required by applicable law or Apple's policies.

8. User Content

You retain ownership of content you create through our Services (e.g., catch logs, photos, messages). By submitting content, you grant FinesseTech a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute that content solely to operate and improve our Services. You represent that you have all rights necessary to grant this license and that your content does not violate any third-party rights.

9. Prohibited Conduct

You agree not to: (a) violate any applicable law or regulation; (b) transmit any harmful, offensive, or unlawful content; (c) impersonate any person or entity; (d) interfere with or disrupt our Services or servers; (e) attempt unauthorized access to any portion of our Services; (f) use our Services to send unsolicited communications; (g) harvest or collect user data without consent.

10. Intellectual Property

All content, features, and functionality of our Services — including text, graphics, logos, icons, software, and design — are owned by or licensed to FinesseTech LLC and are protected by U.S. and international copyright, trademark, patent, and other intellectual property laws. Nothing in these Terms transfers any ownership rights to you.

11. Third-Party Services and Links

Our Services may integrate with or contain links to third-party services (including but not limited to payment processors, mapping services, and analytics providers). We are not responsible for the content, privacy practices, or availability of those services. Your use of third-party services is governed by their respective terms.

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINESSETECH LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50 IF YOU HAVE NOT MADE ANY PAYMENTS.

14. Indemnification

You agree to indemnify, defend, and hold harmless FinesseTech LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of your use of our Services, your content, or your violation of these Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any dispute arising from these Terms or our Services shall first be attempted to be resolved through informal negotiation. If not resolved within 30 days, disputes shall be resolved through binding arbitration under the American Arbitration Association's Consumer Arbitration Rules, except that either party may seek injunctive relief in court. You waive any right to participate in a class action lawsuit or class-wide arbitration.

16. Changes to Terms

We may update these Terms at any time. We will notify you of material changes through our Services or by email. Your continued use of our Services after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using our Services.

17. Termination

We may suspend or terminate your access to our Services at our sole discretion, with or without notice, for conduct that violates these Terms or is harmful to other users, us, or third parties. Upon termination, your license to use our Services ends immediately. Sections 10, 12, 13, 14, and 15 survive termination.

Privacy Policy

1. Introduction

FinesseTech LLC ("FinesseTech," "we," "us," "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our mobile applications, websites, and related services (collectively, "Services"). Please read this policy carefully. By using our Services, you consent to the practices described here.

2. Information We Collect

Information you provide directly:

• Account information: name, display name, email address, password
• Profile information: profile photos, preferences, fishing types, home location (state)
• User-generated content: catch logs, photos, messages, journal entries, gear records
• Communications: support requests, feedback, and email correspondence
• Payment information: processed by Apple App Store — we do not store your payment card details

Information collected automatically:

• Location data: precise GPS coordinates (when you grant permission) for weather conditions, spot saving, and geofence alerts; background location (only when you opt in to condition alerts)
• Device information: device model, operating system version, unique device identifiers
• Usage data: features used, screens visited, session duration, crash reports
• Camera and photo library access: only when you choose to photograph a catch
• Motion data: accelerometer data to detect shake gestures (Mastercast only)

3. How We Use Your Information

We use your information to:

• Create and manage your account
• Provide, operate, and improve our Services
• Personalize your experience (e.g., fishing condition scores based on your catch history)
• Send push notifications you opt into (condition alerts, prime time windows)
• Process transactions and manage subscriptions through Apple
• Respond to support requests and communicate service updates
• Detect and prevent fraud, abuse, and security incidents
• Comply with legal obligations
• Analyze usage to improve product features

We do not sell, rent, or trade your personal data to third parties for marketing purposes.

4. Data Sharing and Disclosure

We may share your information with:

• Service providers: Supabase (database and authentication infrastructure), weather data providers, mapping services, push notification services — all bound by data processing agreements
• Apple Inc.: In-app purchase and subscription data is processed by Apple under their privacy policy
• Law enforcement: When required by law, court order, or to protect the safety of our users or the public
• Business transfers: In connection with a merger, acquisition, or sale of assets, with notice to affected users

We do not share your precise location data with advertisers or data brokers.

5. End-to-End Encryption (Yap)

Messages sent through the Yap application are end-to-end encrypted. FinesseTech cannot read the content of your messages. Encryption keys are generated and stored on your device. We store only metadata necessary to deliver messages (sender, recipient identifiers, timestamp).

6. Data Retention

We retain your personal data for as long as your account is active or as needed to provide Services. If you delete your account, we will delete or anonymize your personal data within 30 days, except where we are required to retain it for legal compliance (e.g., financial records retained for up to 7 years). Anonymized, aggregated data may be retained indefinitely.

7. Account and Data Deletion

You can delete your account at any time: (a) from within the app under Settings → Delete My Account, or (b) by emailing support@finessetech.site with subject "Account Deletion Request." We will process your request within 30 days and confirm deletion by email. This will permanently remove your profile, content, and personal data from our systems, subject to legal retention requirements.

8. Your Privacy Rights

Depending on your location, you may have the following rights:

• Access: Request a copy of your personal data
• Correction: Request correction of inaccurate data
• Deletion: Request deletion of your personal data (see Section 7)
• Portability: Request your data in a machine-readable format
• Opt-out of notifications: Manage push notifications in device settings at any time
• Location permissions: Revoke location access at any time in device settings

9. California Privacy Rights (CCPA)

California residents have additional rights under the California Consumer Privacy Act (CCPA): the right to know what personal information we collect and how it is used; the right to delete personal information; the right to opt out of the sale of personal information (we do not sell personal information); and the right to non-discrimination for exercising these rights. 10. Security

We implement industry-standard security measures including encryption in transit (TLS), encryption at rest, access controls, and regular security reviews. However, no method of electronic transmission or storage is 100% secure. We will notify affected users of any data breach as required by applicable law.

11. Cookies and Tracking Technologies

Our websites may use cookies and similar technologies to remember preferences and analyze traffic. We do not use cross-site tracking cookies for advertising. You can control cookies through your browser settings. Our mobile apps do not use advertising tracking identifiers (IDFA) without your explicit consent.

12. Children's Privacy

Our Services are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us personal information, contact us immediately at support@finessetech.site and we will delete it within 5 business days. Users between 13–17 should use our Services only with parental consent.

13. International Users

Our Services are operated in the United States. If you access our Services from outside the U.S., your information will be transferred to and processed in the United States. By using our Services, you consent to this transfer. We comply with applicable international data protection laws to the extent required.

14. Third-Party Links and Services

Our Services may link to or integrate third-party services. This Privacy Policy does not apply to those services. We encourage you to review the privacy policies of any third-party service you use through or in connection with our Services.

15. Changes to This Policy

We may update this Privacy Policy from time to time. We will post the updated policy here and update the effective date. For material changes, we will notify you through the app or by email at least 7 days before the change takes effect. Your continued use of our Services after the effective date constitutes acceptance of the updated policy.
